Hospitals fight looser rules for independent surgery centers

A rule allowing general surgeons to operate free-standing surgery clinics is on hold while a legal challenge from hospital associations is pending, a spokesman for the Georgia Alliance of Community Hospitals said.
“We asked the court to hold a preliminary hearing so the rule won’t be applied right now,” said Leo Reichert, spokesman for the Tifton, Ga.-based alliance. “We don’t want anyone to build a surgery center while this is pending.”
The alliance, which represents nonprofit and publicly owned hospitals in Georgia, filed a motion in Dougherty County Superior Court on Dec. 28 asking for the overturn of a rule to allow general surgeons to bypass the certificate of need process to opening ambulatory surgery centers, Mr. Reichert said.
